O presidente da Câmara dos Deputados, Rodrigo Maia (DEM-RJ), afirmou ao jornal O Estado de S Paulo que continuará trabalhando para que o Supremo Tribunal Federal (STF) mude a interpretação da lei que garante o benefício para 194 filhas solteiras de ex-parlamentares e ex-servidores, a um custo anual de R$ 30 milhões. Maia chamou de “absurdos” os casos revelados pela reportagem, como a da pesquisadora Helena Hirata, que mora há 49 anos em Paris e recebe R$ 16.881,50 por mês apenas por ser solteira e filha de ex-deputado.

O tribunal alterou a interpretação da lei e obrigou que as pensionistas comprovassem a dependência do benefício para manterem o privilégio.
“Depois da interpretação do Tribunal de Contas da União, o STF deu infelizmente decisão garantindo o direito adquirido. Todos os casos como esses mostrados são absurdos. Vamos continuar investigando, tomando as decisões e trabalhando para que o STF mude sua interpretação e tenha interpretação real daquilo que é o correto, para que não tenhamos privilégios e desperdícios desnecessários”, disse Maia.
As solteiras passaram a reivindicar ao Supremo a manutenção das remunerações. O ministro Edson Fachin suspendeu o acórdão do TCU e determinou a aplicação do entendimento original à lei, o que foi respaldado pela Segunda Turma da Corte. De forma reservada, um integrante do Supremo também classificou os pagamentos como “absurdo”.

Maia destacou que as pensões para filhas solteiras não são pagas por opção da gestão dele e que a direção-geral da Casa vem trabalhando para identificar as fraudes. Até pesquisas nas redes sociais para identificar pensionistas em união estável – condição que suspende o pagamento – estão sendo feitas.
“Esse não é um assunto novo, que foi criado agora. Nos últimos anos a diretoria-geral da Câmara vem organizando isso, pesquisando, investigando e até usando as redes sociais para mostrar casos em que já há relação estável para mostrar as pessoas que casaram, têm família e estão burlando a lei”, comentou Maia.
As pensões são garantidas por uma lei de 1958. Em 1990, outra legislação pôs fim aos pagamentos, mas quem havia adquirido o direito o manteve. Para não perdê-lo, basta permanecer solteira ou não ocupar cargo público permanente. Denúncias de fraudes não faltam. Em dezembro, por exemplo, uma mulher foi indiciada por estelionato pela Polícia Legislativa por ser casada e manter o benefício.
Congressistas ouvidos pelo Estadão/Broadcast avaliam que não há como mexer em direito adquirido, mas cobram uma fiscalização para identificar pessoas que não poderiam mais receber a benesse.
Ex-integrante da Polícia Militar, o deputado Coronel Tadeu (PSL-SP) vê o pagamento das pensões como herança do militarismo no País, em que mulheres e filhas eram totalmente dependentes dos maridos militares.
“A sociedade evoluiu, então no mundo de hoje não cabe mais uma situação como essa. Mas, infelizmente, as 194 pensionistas estão amparadas por lei, é direito adquirido. É preciso esperar até falecerem”, afirmou.
O senador Alessandro Vieira (Cidadania-SE), por sua vez, defende um exame minucioso de cada caso. “Creio que é um direito adquirido, não dá para simplesmente tirar. Mas um pente-fino é interessante”, disse.
