Presidente usou rede social para falar sobre o assunto e disse que governos estaduais não ajudam a reduzir preço de combustíveis
O presidente Jair Bolsonaro afirmou neste domingo (2) que vai encaminhar ao Congresso um projeto de lei para que o Imposto sobre a Circulação de Mercadorias e Serviços (ICMS) de combustíveis, recolhido pelos estados, tenha um valor fixo por litro.
A proposta foi anunciada no Twitter, em meio a críticas do mandatário a uma suposta sanha arrecadatória dos governadores em sua política tributária para o setor.
O presidente culpou os chefes dos executivos estaduais pelo fato de os valores não baixarem nas bombas, apesar de medidas de alívio tomadas pelo governo federal.
– Pela terceira vez consecutiva, baixamos os preços da gasolina e diesel nas refinarias, mas os preços não diminuem nos postos por quê? Porque os governadores cobram, em média, 30% de ICMS sobre o valor médio cobrado nas bombas dos postos e atualizam apenas de 15 em 15 dias, prejudicando o consumidor – declarou o chefe do Executivo.
Bolsonaro disse que, “como regra”, os governadores “não admitem perder receita, mesmo que o preço do litro nas refinarias caia para R$ 0,50 o litro”.
Ele acrescentou que, diante do quadro, vai encaminhar o projeto de lei ao Legislativo e lutar “pela sua aprovação”.
O presidente não deu detalhes do projeto. Adiantou apenas que pretende aprovar uma nova lei complementar para que o tributo tenha “valor fixo por litro”, e não mais seja calculado sobre a “média dos postos”.
Atualmente, o ICMS é uma porcentagem estabelecida por cada estado.
Outras medidas vão constar da proposta, segundo o presidente, que não as detalhou. Questionado pela reportagem, o Ministério de Minas e Energia ainda não se pronunciou.
Na maior parte dos estados, o cálculo do ICMS é baseado em um preço médio ponderado ao consumidor final, atualizado quinzenalmente pelos seus governos. Isso significa que o valor final praticado pelos revendedores pode ser alterado sem que tenha havido mudança na política da Petrobras ou mesmo que o governo federal tenha tomado medidas de sua competência para baixar o valor.
Geralmente, os estados consideram a pesquisa de preços da ANP (Agência Nacional do Petróleo, Gás e Biocombustíveis) para estipular o preço médio ponderado. Em alguns casos, a decisão se baseia em pesquisas próprias, a partir de notas fiscais eletrônicas de venda de combustíveis.
Como noticiou a Folha de S.Paulo em dezembro, segundo especialistas, os governos estaduais vêm garantindo arrecadação extra ao não repassar ao ICMS as variações dos preços da gasolina.
Isso porque as correções do tributo não são feitas no mesmo ritmo das oscilações de valor. A estratégia é vista pelo setor como uma manobra para enfrentar a crise financeira em detrimento do consumidor.
Para Adriano Pires, diretor do Centro Brasileiro de Infraestrutura (CBIE), a mudança defendida por Bolsonaro é positiva. Ele ressalta, no entanto, que deve haver resistência dos governadores.
– Eu acho positivo porque você vai reduzir a volatilidade no preço da bomba e vai diminuir a sonegação. Mas provavelmente ele [Bolsonaro] vai ter resistência dos estados, porque o dinheiro do ICMS do combustível é uma das principais fontes de arrecadação.
Os preços dos combustíveis são um fator importante de desgaste do governo com a população e, em especial, com os caminhoneiros, que ameaçam recorrentemente fazer paralisações por conta dos aumentos do diesel.
Bolsonaro tem atribuído aos estados a responsabilidade pela manutenção dos valores em patamares mais altos que os do passado.
Os governos locais resistem em mudar sua política de tributação e devem influenciar suas bancadas no Congresso a votarem contra propostas que gerem perda de receitas.
O governador de São Paulo, Joao Doria (PSDB), possível adversário do presidente nas eleições presidenciais de 2022, afirmou em 8 de janeiro que “não se estuda e não se vai estudar” a redução de ICMS sobre combustíveis para atenuar uma eventual alta da gasolina.
Na ocasião, as tensões entre Estados Unidos e Irã pressionavam a cotação do barril de petróleo no mercado internacional e Bolsonaro sugeriu aos estados uma mudança na tributação.
– Não há a menor chance de o governo federal depositar essa conta [da alta da gasolina] nos governos estaduais. Não faz o menor sentido isso – declarou.
