O Ministério Público do Amazonas (MPAM), pela 58ª Promotoria de Justiça de Defesa dos Direitos Humanos à Saúde Pública (58ª PRODHSP), obteve decisão judicial em Ação Civil Pública (ACP) que obriga o Estado do Amazonas a dar uma solução definitiva às deficiências dos serviços na área de patologia clínica (medicina laboratorial) da Fundação Centro de Controle de Oncologia do Estado do Amazonas (Fcecon).
Com a decisão, as “biópsias”, exames que determinam, com precisão, se o caso é câncer, deverão ser concluídas em até 30 dias. Foi estabelecido o prazo de 100 dias úteis para que as providências requeridas pelo MPAM sejam adotadas, sob pena de multa diária de R$ 60 mil, até o teto de R$ 6 milhões. A sentença foi proferida em 27 de janeiro de 2020.
“O Estado do Amazonas está condenado a se organizar para dar o diagnóstico de câncer em até 30 dias. Hoje, o paciente vai para a primeira consulta e o médico pede uma biópsia para confirmar a doença, eles fazem uma cirurgia e retiram um pedaço de um órgão da pessoa, mas esse material fica guardado. Só se começa uma quimioterapia, radioterapia ou cirurgia com o diagnóstico fechado, mas os diagnósticos não chegam a tempo. O paciente nem volta para a segunda consulta, as pessoas morrem sem o diagnóstico”, explicou a titular da 58ª PRODHSP, Silvana Nobre.
Para dar conta da demanda de exames, a FCecon deverá consolidar seu quadro funcional do setor de patologia, com lotação definitiva de todos os técnicos da área que estavam ou estão à disposição de outros órgãos públicos. De acordo com a ACP proposta pelo MPAM e com a sentença, o quantitativo de cargos criados em lei é condizente com a necessidade da FCecon. Para estruturar o quadro funcional na área, além do provimento de todos os cargos vagos de técnicos em patologia clínica, também deverão ser providos todos os cargos vagos de médicos patologistas.
Também foi determinado, a pedido do MPAM, que o montante de material coletado para exames histopatológicos (biópsias), tanto de pacientes vivos como dos que já faleceram, sejam concluídos com as devidas expedições de laudos no prazo máximo de 60 dias.
